By using this website or purchasing any itinerary, you agree to the Travel Disclaimer and Limitation of Liability outlined below.
1. Scope of Services
Owen’s Travel Co. LLC provides customized travel itinerary planning services, including research, recommendations, logistical guidance, and curated travel suggestions tailored to each client’s travel preferences.
Services may include recommendations for accommodations, transportation options, restaurants, tours, activities, and travel logistics.
Unless explicitly stated otherwise in writing, Owen’s Travel Co. LLC does not make bookings, reservations, or purchases on behalf of clients and does not act as a travel agency, tour operator, transportation provider, accommodation provider, booking service, insurer, or fiduciary.
Clients are responsible for independently verifying availability, pricing, reservation requirements, travel restrictions, and other relevant details directly with third-party providers before making bookings.
2. Payment & Refund Policy
Planning fees compensate Owen’s Travel Co. LLC for time spent researching, designing, and preparing customized travel itineraries.
Because research and itinerary development begin after payment is received, planning fees are non-refundable once work has commenced or access to digital materials has been provided.
Payment of any invoice or digital product purchase confirms acceptance of these Terms & Conditions.
3. Limitation of Liability
Owen’s Travel Co. LLC shall not be liable for indirect, incidental, consequential, special, or punitive damages.
Our total liability for any claim shall not exceed the amount paid for planning services or digital itinerary access.
4. Assumption of Risk
Clients understand and acknowledge that travel and related activities involve inherent and unpredictable risks, including but not limited to personal injury, illness, property damage, financial loss, delays, cancellations, and changing conditions.
By engaging Owen’s Travel Co. LLC and proceeding with travel arrangements, clients voluntarily assume all such risks. Clients agree that they are solely responsible for their personal safety, travel decisions, and participation in any activities during their trip.
5. Client Responsibility
Clients are responsible for ensuring they possess valid passports, visas, vaccinations, travel insurance, and any other documentation required for travel.
Owen’s Travel Co. LLC is not responsible for denied entry, missed flights, documentation issues, vaccination requirements, visa issues, passport validity problems, or compliance with travel regulations imposed by governments, airlines, or other authorities.
Clients are responsible for determining whether suggested activities are appropriate for their health, fitness level, and personal circumstances.
6. Indemnification
Clients agree to indemnify, defend, and hold harmless Owen’s Travel Co. LLC from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising out of:
Client travel decisions
Third-party vendor disputes
Misuse of itineraries
Violation of these Terms
Participation in travel activities
7. Force Majeure
Owen’s Travel Co. LLC shall not be liable for failure or delay in performance due to causes beyond our reasonable control, including but not limited to:
Natural disasters
Severe weather
Acts of government
Travel bans
Pandemics
Civil unrest
Airline disruptions
Labor strikes
8. Independent Contractor Status
Owen’s Travel Co. LLC operates solely as an independent contractor providing advisory services.
We are not a travel agency, tour operator, insurer, transportation provider, booking agent, or fiduciary unless expressly stated in writing.
9. No Warranties
All services, itineraries, digital products, and website content are provided “as is” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
10. Travel Disclaimer & Limitation of Liability
Owen’s Travel Co. LLC provides travel itineraries, guides, and recommendations for informational and planning purposes only. We are not a travel agency, tour operator, transportation provider, accommodation provider, booking service, insurer, or fiduciary unless expressly stated in writing.
All recommendations, accommodations, transportation options, restaurants, activities, and logistical suggestions are provided based on research and personal experience at the time of publication. Availability, pricing, hours of operation, reservation policies, safety conditions, travel restrictions, health regulations, entry requirements, weather conditions, and other details are subject to change without notice.
Travelers are solely responsible for independently verifying all reservations, availability, entry requirements, documentation requirements, safety advisories, travel regulations, and any other relevant details prior to booking or traveling.
All purchases are for informational travel planning services and digital content only and do not constitute professional travel, legal, financial, medical, or safety advice.
Owen’s Travel Co. LLC shall not be held liable for any loss, injury, illness, delay, inconvenience, property damage, financial loss, expense, cancellation, third-party dispute, or other claim arising out of or related to the use of any itinerary, recommendation, or travel information provided.
By purchasing or using our itineraries, you acknowledge and agree that you assume full responsibility for your travel decisions, bookings, and participation in any travel-related activities.
11. Changes to Travel Details
Travel details such as operating hours, reservation policies, pricing, availability, safety conditions, and travel requirements may change after an itinerary is created.
Owen’s Travel Co. LLC is not responsible for changes made by third-party suppliers after an itinerary has been delivered.
Clients are responsible for confirming all reservations and details directly with service providers before travel.
12. Intellectual Property
All itineraries, travel guides, planning materials, and digital products provided by Owen’s Travel Co. LLC are protected intellectual property.
Clients may not reproduce, resell, distribute, share, publish, copy, modify, or commercially exploit materials without prior written consent.
13. Chargebacks & Disputes
Clients agree that planning fees and digital product purchases are earned upon commencement of work or delivery of access.
Initiating a chargeback without first contacting us to attempt resolution constitutes a breach of these Terms.
We reserve the right to:
Terminate services immediately
Submit documentation to the payment processor
Pursue legal recovery of fees
14. Dispute Resolution & Arbitration
Any dispute arising from these Terms shall be resolved through binding arbitration in the Commonwealth of Virginia.
You waive the right to:
A jury trial
Participation in class action lawsuits
Each party shall bear its own legal fees unless otherwise determined by the arbitrator.
15. Governing Law & Venue
These Terms are governed by the laws of the Commonwealth of Virginia.
Any legal proceedings not subject to arbitration shall be brought exclusively in courts located within Virginia.
16. Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
17. Waiver
Failure to enforce any provision shall not constitute a waiver of future enforcement of that provision or any other provision.
18. Entire Agreement
These Terms constitute the entire agreement between the parties and supersede all prior communications, representations, or agreements.
19. Electronic Agreement
By submitting payment, checking the agreement box, or using our services, you acknowledge and agree to these Terms electronically, which shall have the same force as a signed written contract.
